1. About These Terms

These terms and conditions govern your use of Design Wall ("the Service"), operated by Shelfless SAS, a company registered in France (SIREN: 891131062, VAT: FR60891131062) with registered address at rte de Sissac, 87300 Peyrat de Bellac, France.

By using Design Wall, you agree to these terms. If you don't agree, please don't use the Service.

2. Who Can Use Design Wall

You must be at least 18 years old to use Design Wall. By creating an account, you confirm that you meet this age requirement.

If we discover that someone under 18 has created an account, we'll terminate that account immediately and delete all associated data.

3. Your Account

Creating an account

You can use Design Wall without an account (with one canvas stored locally on your device), or create a free account to access up to three canvases.

If you create an account, you're responsible for:

  • Keeping your login details secure
  • All activity that happens under your account
  • Notifying us immediately if you believe your account has been compromised

Account security

Don't share your account with others. If we believe your account security has been compromised, we may suspend it temporarily whilst we investigate.

4. Subscription Plans

Free tier

  • Up to 3 canvases
  • Stored locally on your device
  • No payment required

Hobby tier (€2.49/month or €25/year)

  • Up to 20 canvases
  • Cloud storage and syncing across devices
  • Billed monthly or annually

Passion tier (€9.99/month or €99/year)

  • Up to 100 canvases
  • Cloud storage and syncing across devices
  • Billed monthly or annually

All prices exclude VAT where applicable. VAT will be added at checkout based on your location.

Payment

Payments are processed by our third-party payment provider, Paddle. We don't store your payment card details. By subscribing to a paid plan, you authorise us to charge the subscription fee to your chosen payment method on a recurring basis until you cancel.

Cancellation

You can cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You'll retain access to your paid features until then.

Refunds

For annual subscriptions: If you cancel, you may receive a pro-rata refund for any complete, unused months remaining in your subscription period. Contact us at [support email] to request a refund.

For monthly subscriptions: No refunds are provided. Your subscription will simply not renew at the end of the current month.

We reserve the right to refuse refunds in cases of account termination due to violation of these terms.

What happens when you downgrade or stop paying

If you downgrade from a paid plan to the free tier, or if your payment fails and you don't update your payment details:

  • Your cloud-stored canvases will be preserved as read-only for 12 months
  • Your 3 most recently edited canvases will remain editable but will be stored locally on your device only
  • After 12 months of continuous non-payment, your cloud-stored canvases will be permanently deleted
  • You can request earlier deletion of your cloud data at any time by contacting us at [support email]

5. Your Content

What you upload

You retain all rights to the content you create and upload to Design Wall (text, images, and other materials). We don't claim ownership of your content.

By uploading content to Design Wall, you confirm that:

  • You own the content or have the necessary rights to use it
  • Your content doesn't violate anyone else's intellectual property rights
  • Your content doesn't contain anything illegal

Licence to us

To provide the Service, you grant us a limited licence to store, display, and transmit your content. This licence exists solely to enable us to operate Design Wall and provide it to you. We won't use your content for any other purpose.

Backups

You can back up your canvases at any time using our export function. Backups are saved in our proprietary JSON format. Whilst we take reasonable steps to protect your data, we strongly recommend keeping your own backups of important work.

6. Acceptable Use

You agree not to:

  • Use Design Wall for any illegal purpose
  • Upload content that infringes others' intellectual property rights
  • Upload content that is abusive, threatening, obscene, or hateful
  • Attempt to gain unauthorised access to our systems or other users' accounts
  • Use automated systems or scripts to access the Service in ways that could damage or overload our infrastructure
  • Resell, redistribute, or provide access to Design Wall to third parties
  • Reverse engineer, decompile, or attempt to extract the source code of the Service

7. Our Rights

Service changes

We may modify, suspend, or discontinue any part of Design Wall at any time. We'll give you reasonable notice of significant changes where possible, but we're not liable for any modifications or interruptions to the Service.

Account termination

We reserve the right to suspend or terminate your account immediately and without notice if:

  • You violate these terms
  • You engage in abusive behaviour towards us or our support staff
  • You use the Service for illegal activities
  • You abuse the Service (for example, through automated scripts or attempts to overload our systems)
  • You initiate a chargeback or payment dispute that we believe is unjustified
  • We're required to do so by law

If we terminate your account for violation of these terms, you won't be entitled to a refund, and we may delete your data immediately.

8. Limitations and Disclaimers

"As is" service

Design Wall is provided "as is" without warranties of any kind. Whilst we work hard to provide a reliable service, we can't guarantee that:

  • The Service will always be available or uninterrupted
  • The Service will be error-free
  • Your data will never be lost (this is why we encourage you to keep backups)

Limitation of liability

To the maximum extent permitted by French law:

  • We're not liable for any indirect, incidental, or consequential damages arising from your use of Design Wall
  • Our total liability to you for any claims related to the Service is limited to the amount you've paid us in the 12 months before the claim arose
  • We're not responsible for any loss of data, profits, or business opportunities

Nothing in these terms excludes our liability for death or personal injury caused by our negligence, or for fraud.

9. Privacy and Data Protection

We take your privacy seriously. Please read our Privacy Policy to understand how we collect, use, and protect your personal data.

10. Intellectual Property

Design Wall, including its software, design, and content, is owned by Shelfless SAS and protected by copyright and other intellectual property laws. You're granted a limited licence to use the Service, but you don't acquire any ownership rights.

11. Disputes and Governing Law

These terms are governed by French law. Any disputes will be subject to the exclusive jurisdiction of the French courts.

12. Changes to These Terms

We may update these terms from time to time. If we make significant changes, we'll notify you by email (if you've provided one) or through a notice in the Service. Your continued use of Design Wall after changes take effect means you accept the new terms.
